Terms and Conditions for Individuals
Below are the conditions of the agreement between you and Twin World Languages, 65 – 71 Lewisham High Street, London SE13 5JX, Company Registration Number 1029478 England. Written authority from Twin World Languages may be given to specific requests to vary these conditions.
“You” means a person/s, body or organisation, who has signed an application form for a course (if under 18 years of age, a parent or adult acting in loco parentis). All bookings are subject to the terms and conditions of the partner school or travel operator. Twin World Languages acts as a booking agent, and as such does not own or operate any transport, school, accommodation or other facility. Our AgreementThis agreement is legally binding when your completed and signed enrolment form is accepted by Twin World Languages, together with the relevant payment. Or, if your booking is taken by email, fax or telephone, when the details have been completed by Twin World Languages and the relevant payment has been made by the agreed means, such as credit card. This agreement will be governed by English Law, we both agree that any dispute will be dealt with by the English Courts. Financial ProtectionIn order to ensure that the monies you pay for your holiday are protected we will issue a confirmation invoice showing the details of the services that you have booked including the price and the amount of money paid by you. You should check these details carefully and contact your travel agent or us immediately if there are any discrepancies. Changes to Brochure Details Twin World Languages reserves the right to make changes to the particulars within this brochure concerning changes or cancellation to existing clients’ holiday arrangements. Enrolment and Payment Twin World Languages provides you with tuition, accommodation and insurance for language courses through its agents in specified countries. The completed enrolment form, together with your deposit of £100 must be sent to Twin World Languages together with the relevant insurance premium. Alternatively, the form may be completed by Twin World Languages by telephone and the payment taken from a credit card. The deposit and insurance premium are non-refundable. On receipt of your deposit, Twin World Languages will provide you with a full invoice which confirms your booking. Any remaining balance must be received and cleared six weeks prior to departure (as specified on the invoice by Twin World Languages). In the event of default in payment, Twin World Languages shall be entitled to cancel your booking and this agreement. All funds paid by you at that time are considered non-refundable. You may also have to pay cancellation charges as detailed below. Twin World Languages reserves the right to take necessary legal action to recover the balance payable for your booking. If you book within six weeks of departure, the entire costs of your course and accommodation must be paid at the time of enrolment. All funds must be cleared, at no cost to Twin World Languages, at least one day before departure. An administrative charge of £25 will be made for late bookings within 10 days of departure or for any change in booking details requested by the client less than six weeks before departure. Data ProtectionPlease be assured that we have measures in place to protect the personal booking information held by us. This information will be passed on to the language school or agent providing the services. The information may also be provided to public authorities such as customs or immigration if required by them, or as required by law. Certain information may also be passed on to security or credit checking companies. If you travel outside the European Economic Area, controls on date protection may not be as strong as the legal requirements in this country. We will only pass your information on to persons responsible for supplying the services booked by you. This applies to any sensitive information that you give to us such as details of any disabilities, or dietary/religious requirements. (If we cannot pass this information to the relevant suppliers, whether in the EEA or not, we will be unable to provide your booking. In making this booking, you consent to this information being passed on to the relevant persons.) Full details of our data protection policy are available on request. SurchargesPrices may be subject to surcharges in the event of exchange rate fluctuations or Government action (eg VAT). We will absorb an amount equivalent to 2% of the tour price, which excludes insurance and any amendment charges. Only amounts in excess of this 2% will be surcharged, but where a surcharge is payable, there will be an administration charge of £1 per person. If this means paying more than 10% on the tour price, you will be entitled to cancel your holiday with a full refund of all money paid except for any premium paid to us for holiday insurance and amendment charges. Should you decide to cancel because of this, you must exercise your right to do so within 14 days from the issue date printed on the final or surcharge invoice. After the final balance has been paid, we guarantee that no exchange rate surcharge will be applied. In guaranteeing the price of your holiday after payment of your final balance no refunds arising out of cost variations will be made. The prices contained in this brochure are valid until 31 December 2006. The prices shown are calculated on known costs and rates of exchange prevailing on 4 March 2005 as published in the Financial Times World Currency Table on 7 March 2005 (US$ 1.9258, €1.4541). Travel ArrangementsIt is your responsibility to make all necessary travel arrangements. We are happy to discuss these with you. Travel DocumentsIt is your responsibility to have the relevant valid travel documents such as passport, visa, green card, and you should confirm these with the relevant Embassies and/or Consulates. We do not accept any responsibility if you cannot travel because you have not complied with any passport, visa or immigration requirements. InsuranceThe cost of medical and other treatment overseas can be high. Therefore it is a condition of booking a course with us that you take out our insurance, or another policy offering the same or greater protection. If you arrange your own travel insurance, you must complete our indemnity form and send us a copy of your policy for our records. If you are travelling to Europe, you need a valid E111 certificate as well as your travel insurance. You can obtain an application form at the Post Office, or download one from www.dh.gov.uk/travellers. At the end of 2005 the E111 will be replaced by a European Health Insurance Card (EHIC). Further advice can be obtained at www.doh.gov.uk/traveladvice Cancellation by youIf you or anyone on your booking decides to cancel the course, we must be notified in writing. The cancellation will take effect from the day the written confirmation is received. Any costs or damages arising from you cancelling or curtailing your course are your sole responsibility. The following scale of charges will be payable depending on when the notification is received.
Under certain circumstances your insurance may cover for loss of deposit or cancellation fees. Individual prices may change if one or more of a group booking cancel. If you cancel your booking, we will not refund any insurance premium paid. If you change or transfer your bookingWe will always try to assist you if you wish to transfer or change your booking details. You must notify us in writing and an amendment fee of £25 per person will be charged together with any further costs incurred as a result of the change. We may alter or waive these costs at our discretion. Twin World Languages does not accept any liability or responsibility for changes in arrangements for transport, accommodation, tuition or any other matter made by third parties. We will not be liable to pay compensation in such cases. Change or cancellation by us It is unlikely that we will need to make any major change to the services booked by our clients, but if the need arises, we will offer you an alternative or a refund, except in the case of force majeure. In the case of minor changes, an alternative will always be offered. Force majeure: This means that we will not pay you compensation if we have to cancel or change your travel arrangements in any way because of unusual or unforeseeable circumstances beyond our control. These can include, for example, war, riot, industrial dispute, terrorist activity and its consequences, natural or nuclear disaster, fire, adverse weather conditions.
